Affidavit of Death

A sworn statement that someone has passed away. It is signed by a relative or a person close to the deceased, and is recorded with a Certified Death Certificate. Recording this Affidavit is an important step for the successors when taking title. The Affidavit of Death itself doesn't transfer title, but it does trigger the succession process that you've laid out in your Trust or Will.

Since a Death Certificate has already been issued, it might feel like you're recording the obvious. But that's because County Recorders need a clear step-by-step record for title: this Affidavit is how that Death Certificate is recorded.
